The UNIX code for this is:

                        if (pFrame->isDirty() || pFrame->getFilename() ||
                                (pFrame->getViewNumber() > 0))
                        {
                                pNewUnixFrame = pApp->newFrame ();
                        }
                        else
                        {
                                pNewUnixFrame = pUnixFrame;
                        }
                        error = pNewUnixFrame->loadDocument(filename, 0 /*
IEFT_Unknown */);

You can definitely use the logic from the if statement there to help you on
win32.
